RE: Open Records Request of July 11, 2023, Reference # P107616-071123

Dear Mr. Diamond,

The City of Cincinnati received a Public Records Request from you on July 11, 2023. This is a duplicate request to the one you submitted under Reference # P107615-071123.  That request was closed as you did not respond to our request for clarification.
The Public Records Act "does not contemplate that any individual has the right to a complete duplication of voluminous files kept by government agencies." State ex rel. Glasgow v. Jones, 119 Ohio St. 3d 391, ¶ 17 (2008). This request effectively requires the City to search emails of all City employees. In addition, the search terms are – in effect – very broad. As such, this request constitutes a request for a complete duplication of the City's emails for a particular time period. It is therefore overly broad. State ex rel. Glasgow v. Jones, 119 Ohio St. 3d 391 (2008); State ex rel. Daugherty v. Mohr, 2011-Ohio-6453 (10th Dist. 2011). The City of Cincinnati requests that you narrow the scope of your request to identify more particular subject matters so that we may properly respond to the request. A public records request must state "specifically and particularly" the records being requested so that the public office can identify responsive records based on the manner in which it ordinarily maintains and accesses those records. State ex rel. Glasgow v. Jones, 119 Ohio St. 3d 391, 894 N.E.2d 686 (2008). Your request is therefore overbroad. State ex rel. Zidonis v. Columbus State Community College, 133 Ohio St.3d 122, 2012-Ohio-4228. As such, we ask that you identify specific topics that you would like us to use to search. Please reply within ten (10) business days or your request will be closed, and you will be required to submit a new request.
