-The incident report produced as a result of the arrest of Dan Heyman on Tuesday, May 9, 2017 at the West Virginia State Capital building.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Please understand that the Secretary of the Department of Military Affairs and Public Safety is not the custodian of the records you are requesting, however your request has been forwarded to me for response as a courtesy.

Hello,
I don't believe the initial incident report is exempt from disclosure. I'm seeking the incident report filed as a result of Mr. Heyman's arrest, and while WV law allows for the exemption of "Records of law-enforcement agencies that deal with the detection and investigation of crime and the internal records and notations of such law-enforcement agencies which are maintained for internal use in matters relating to law enforcement." I don't understand how the initial report could be so integral to the investigation as to compromise it. The incident has been widely reported, and I'm just looking for the official version of events . Thank you!
