Pursuant to the South Carolina Public Records Law, I hereby request the following records:

All documents pertaining to the city’s emergency plans for a heat wave or for extreme heat.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

This is in response to your Freedom of Information Act ("FOIA") request regarding "information for all emails sent during January, 2017." More specifically - the from address, to address, bcc addresses, cc addresses, time and date.

As it pertains to "access to public documents," S.C. Code Ann. § 30-4-15, please note that South Carolina FOIA defines a "public record" in terms of certain documentary materials "prepared, owned, used, in the possession of, or retained by a public body." See S.C. Code Ann. § 30-4-20(c). The South Carolina FOIA does not require a public body such as the City of Charleston to devote staff time or to expend other public resources to create new records that were not previously in existence for purposes of responding to and fulfilling FOIA requests. See S.C. Code Ann. § 30-4-30(a)(2).

In responding to your FOIA request, the City did not locate any documents in existence responsive to your request. This completes the our response to your request and we now consider the matter to be closed.
