Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

1. All incident reports or other records documenting each time your agency's S.W.A.T. team (sometimes called a police paramilitary unit) was deployed.

2. In the event such records are not kept, I request a list of the dates of deployment of the agency's S.W.A.T. team during this period.

3. In the event these records/dates are not available for the entire time period covering this request, I request you supply the above information for the period covering the present back to as long as such records/information are available.

This request is being made for academic, not commercial, purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Jonathan Mummolo,

The Department of California Highway Patrol (Department) hereby responds to your request under the California Public Records Act (CPRA), dated June 16, 2015.

In your request, you submitted the following search parameters:

1. All incident reports or other records documenting each time your agency's S.W.A.T. team (sometimes called a police paramilitary unit) was deployed.

2. In the event such records are not kept, I request a list of the dates of deployment of the agency's S.W.A.T. team during this period.

3. In the event these records/dates are not available for the entire time period covering this request, I request you supply the above information for the period covering the present back to as long as such records/information are available.

The Department has determined that it will comply, in part, with your request. Records relating to the deployment of its Special Weapons and Tactics (SWAT) Team are confidential. Public dissemination of such information could compromise officers' tactical advantage, as well as their safety. Therefore, the Department is withholding these records on the basis of Government Code section 6255, because the public interest served by not disclosing the record (effective law enforcement, officer safety) clearly outweighs the public interest served by disclosure of the record (speculative informational value).

In an effort to be helpful, however, departmental personnel have reviewed relevant records, extracted data regarding deployment of the Department's SWAT Team, and compiled that data for your review. (Please see the attached file.)

Normally, CPRA requesters must either pay a duplication fee or the actual cost of constructing a record. (Gov. Code, §§ 6253, subd. (b), 6253.9, subd. (b)(2).) In this particular instance, however, the Department is providing this record to you free of charge.

Attorney Suzanne R. Moser made the determination to withhold SWAT Team records on the basis of Government Code section 6255.

Thank you very much for this helpful reply to my request. I appreciate the time and effort that went into this. As a courtesy, I wonder if someone could clarify / reply to the following:

1. When was the CHP SWAT team founded (month and year if possible)?

2. I assume the CHP is not formally a part of any joint SWAT team with other agencies, is that correct?

3. Is there any way to share with me the original .doc or .xls file that lists the SWAT callouts you provided? This will help me to prevent transcription errors that could occur if I manually re-copy the data from the pdf to a new spreadsheet.
