Pursuant to the California Public Records Act, I hereby request the following records:

Any communications, emails, typed or handwritten notes of phone calls, conversations or meetings, recordings of Zoom, Web Ex or other electronic/remote meetings that discuss or mention the closure of Oceano Dunes SVRA to pedestrians, horses, vehicle traffic or camping with regards to Covid 19.

Any communications, emails, typed or handwritten notes, recordings of Zoom, Web Ex or other electronic/remote meetings that discuss or mention the closure of Oceano Dunes SVRA to pedestrians, horses, vehicle traffic or camping with regards to the Pandemic.

Any communications, emails, typed or handwritten notes, recordings of Zoom, Web Ex or other electronic/remote meetings that discuss or mention the closure of Oceano Dunes SVRA to pedestrians, horses, vehicle traffic or camping with regards to the Snowy Plover.

Any communications, emails, typed or handwritten notes of phone calls, conversations or meetings, recordings of Zoom, Web Ex or other electronic/remote meetings that discuss or mention the closure of Oceano Dunes SVRA to pedestrians, horses, vehicle traffic or camping for any reason whatsoever.

The above request should include, but not limited to, all communications, emails, typed or handwritten notes, recordings of Zoom, Web Ex or other electronic/remote meetings that were internal to the California State Parks, OHMVR Division, California Coastal Commission, The Governor's Office, any Covid Task Force, and any private or public entity.

The date range for the above records are from January 01, 2020 to September 25, 2020.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Commission staff continues to gather and search for records responsive to your request. At this time, we have prepared additional records for release. We have determined that some records responsive to your request are exempt from disclosure, including material that constitutes attorney-client privilege (Government Code § 6254(k); Evidence Code § 954); documents that constitute attorney work-product (Government Code § 6254(k); Code of Civil Procedure 2018.030); preliminary drafts, notes, or interagency memoranda that are not retained by the Commission in the ordinary course of business and the public interest in withholding those records clearly outweighs the public interest in disclosure (Government Code § 6254(a)); and certain internal staff records under authority of the “deliberative process” privilege authorized by the PRA (see Times Mirror v. Sup. Ct. (1991) 53 Cal.3d 1325; Government Code §6255(a)).

If, during Commission staff’s review of additional records, any additional exempt material is identified, I will notify you in writing of the basis for withholding any such records. I anticipate being able to provide you with a final response by December 4, 2020, though I will be in touch sooner if possible.
