Dear Kelly Swanson:

The Department of California Highway Patrol (Department) has reviewed your request for public records pursuant to the California Public Records Act (CPRA) (Gov. Code, § 6250 et seq.), dated March 13, 2017.

In your request, you asked for the following:

· All arrest reports for driving under the influence of marijuana offenses that took place between January 1, 2014 and December 31, 2016.

The Department is determining whether you seek copies of disclosable public records in the Department's possession. This will require Department staff from the Office of Community Outreach and Media Relations to search for, collect, and appropriately examine a voluminous amount of separate and distinct records that are required in a single request. Department staff will also be required to search for and collect the requested records from field facilities that are separate from the office processing the request. This search is further complicated by the nonspecific nature of your request, as described in an email to you on Monday, March 20, 2017. Accordingly, the Department is extending its 10-day response timeframe by an additional 14 days, as authorized by Government Code section 6253, subdivision (c).

On or before Friday, April 7, 2017, the Department will notify you of its determination regarding this request.

In the meantime, please feel free to contact this office to help us better understand the request.

Dear Ms. Swanson:

The Department of California Highway Patrol (Department) has reviewed your request for public records pursuant to the California Public Records Act (CPRA) (Gov. Code, § 6250 et seq.), dated April 30, 2017. The Department received your request on May 1, 2017. Please accept this written notice of the Department's records determination.

In your request, you asked for the following:

· A list or dataset of all of the law enforcement officers who have undergone the Drug Recognition Expert/Evaluator training in California from January 1, 2013 to April 1, 2017 including, but not limited to: the officer's name, date of birth, jurisdiction of where they work, their title, the date of their first certification and if they have been recertified in the program.
The Department has determined that it possesses public records that are, in part, responsive to your request. The Professional Training Section has compiled "DRE Recertification Course Attendees 2013-2017" and "Drug Recognition Evaluator School Attendees 2013-2017."

The Department has compiled a 155-page set of records and a 36-page set of records in response to your request. The Department will withhold certain information from these records on the following legal bases:

· Government Code section 6254, subdivision (c)

· Government Code section 6254, subdivision (k), which incorporates the individual's right to privacy under the California Constitution (Cal. Const., art. I, § 1) and the Information Practices Act (Civ. Code, § 1798 et seq.)

DUPLICATION FEE

In response to your request, the Department has compiled a 191-page set of records. To offset its duplication costs, the Department currently charges requesters a duplication fee of $0.30 per page and $5.00 per CD for records. Therefore, if you wish to receive hard copies of these records, please forward a check in the amount of $57.30 to the California Highway Patrol, Office of Community Outreach and Media Relations, P.O. Box 942898, Sacramento, CA 94298-0001 (Attention: Janelle Dunham). Please make the check payable to the "California Highway Patrol" and note file no. 2017-27 on the check. Alternatively, if you would like to receive electronic copies of these records on CD, please forward a check in the amount of $5.00. Once the Department receives this payment, these records will be prepared and mailed to you on an expedited basis.
