Pursuant to the California Public Records Act, I hereby request the following records:

Any surveillance or reconnaissance photographs taken from California Highway Patrol helicopters during the investigation into the East Area Rapist investigation in the mid 1970s. According to a recently released podcast called "Criminology" the CHP provided Sacramento era law enforcement with detailed aerial photographs of crime locations.

Here is a link to a podcast episode, where a retired Sacramento County Sheriff's Detective describes how the CHP's helicopters were widely used to aerially photograph crime scenes. These aerial photos are discussed at around the 48:47 mark ("we took aerial photos by the CHP helicopters of all the victim's residences") of the podcast:

Here is a link to a forum post which details a June 1977 article in the Sacramento North Highlander newspaper where the CHP publicly confirmed the use of CHP helicopters in the East Area Rapist investigation:

The release of these photographs would not jeopardize the successful completion of an ongoing investigation because the location of each and every incident is widely known and discussed on dozens of internet websites and on online forums such as Reddit and Websleuths. For several years private individuals have been visually documenting each and every location and posted this information onto the internet. Numerous aspects of this case have been widely discussed, and he locations of the incidents is common knowledge.

The digitization (if they haven't yet been digitized) and release of these photos would benefit both the historical record, and show the CHP's commitment to continue their commitment to solving this case. Thank you for your commitment to transparency.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

The California Highway Patrol (CHP), Office of Community Outreach and Media Relations (COMR) received your request for public records pursuant to the California Public Records Act (CPRA) on March 29, 2018.

In your request, you asked for the following:

Any surveillance or reconnaissance photographs taken from California Highway Patrol helicopters during the investigation into the East Area Rapist investigation in the mid 1970s..

The Office of COMR is currently researching the matter in order to determine whether you seek copies of disclosable public records in the Department's possession. This will require personnel to search for, collect, and appropriately examine the requested records from field facilities or other establishments that are separate from the office processing the request. Accordingly, the Department is extending its 10-day response timeframe by an additional 14 days, as authorized by Government Code section 6253, subdivision (c).

On or before Tuesday, April 24, 2018, the Department will notify you of its determination regarding your request.
