The California Department of Motor Vehicles acknowledges receipt of your email received on January 9, 2023, requesting the following records pursuant to the California Public Records Act (Government Code section 7920.000 et seq.).

"An electronic file containing all records from your office's autonomous vehicle incident database, which is promoted at the following URL: https://www.dmv.ca.gov/portal/dmv-autonomous-vehicles-feedback-form/"

Government Code section 6253, subdivision (c), allows the Department a fourteen (14) day extension to respond to a California Public Records Act request in "unusual circumstances," as enumerated in subdivision (c). The following "unusual circumstances" apply to this matter:

* The need to search for and collect the requested records from field facilities or other establishments that are separate from the office processing the request.

Accordingly, the Department will inform you of its decision within fourteen (14) days from the date of this communication.

Dear Mr. Welsh:

The California Department of Motor Vehicles further responds to your email received on January 9, 2023, requesting the following records pursuant to the California Public Records Act (Government Code section 7920.000 et seq.).

"An electronic file containing all records from your office's autonomous vehicle incident database, which is promoted at the following URL: https://www.dmv.ca.gov/portal/dmv-autonomous-vehicles-feedback-form/"

Attached is the document responsive to your request. Please note that the Department has redacted portions of the document consist of personal information such as names, phone numbers, license plates, and email addresses that have been submitted via the Department's Autonomous Vehicles Incident Form. The Department has determined the disclosure of such information would be an infringement on the privacy of such individuals, and the redaction is necessary to preserve the public's willingness to provide such information to the Department, which may assist the Department in its task of regulating autonomous vehicle manufacturers. (Please also see the Information Practices Act, Civil Code section 1798 et seq.; the Driver's Privacy Protection Act, Public Law 103-322, 18 U.S.C. sections 2721-2725; and the Right of Privacy under the California Constitution, Article I, Section 1.) As such, the Department has determined the public interest in withholding these records outweighs the public interest in disclosure. As required by the California Public Records Act, the person responsible for the determination to withhold responsive records pursuant to Government Code section 7922.000 is Miguel Acosta, Chief of the Autonomous Vehicles Branch, Policy Division, of the Department of Motor Vehicles. (See Government Code section 7922.540(b).)
