Pursuant to the Vermont Public Records Act, I hereby request any lists or databases regarding the credibilty of police officers. Such lists are common in many jurisdictions, and go by names such as "Giglio lists," "Brady lists," "bad cop lists," "police credibility lists," or "do not call lists." Please provide the list in its entirety, which should include, at a minimum, the name of each officer on the list, and information about why the officer is on the list.

Furthermore, I am requesting any other records that refer to or discuss said lists, such as policies regarding when or how officers are added to the lists, when and how officers are removed, and how the lists are used.

Dear Mr. Waters:

I am responding to you as the Public Records Officer of the Department of State's Attorneys and Sheriffs on behalf of the Chittenden County State's Attorney's Office. This letter is in regard to your request for the materials listed below under the Vermont Public Records Act received by the Department on May 6, 2019:

"any lists or databases regarding the credibility of police officers"

"any other records that refer to or discuss said lists, such as policies regarding when or how officers are added to the lists, when and how officers are removed, and how the lists are used"

A search of the Chittenden County State's Attorney's Office's records failed to identify any records responsive to your request for "any lists or databases regarding the credibility of police officers." A search of the Chittenden County State's Attorney's Office's records identified one record responsive to the request for "any other records that refer to or discuss said lists, such as policies regarding when or how officers are added to the lists, when and how officers are removed, and how the lists are used." This record is being withheld at this time pursuant to 1 VSA 317(c)(17) as it is an inter/intradepartmental communication that is preliminary to a determination of policy. This record is also exempt from disclosure as it is protected under deliberative process privilege.

Nothing in this letter should be construed as a waiver of any privileges or protections over the records of the Chittenden County State's Attorney's Office.
