From: MuckRock

This message is in response to your letter dated May 1st, 2017 outlining the estimated fees to process public records request requests@muckrock.com. In an effort to decrease the amount of County staff time and fees related to fulfilling the request please narrow the search criteria as follows:

1.) Instead of extracting emails from 16 mail boxes please provide the requested emails from these eight Broward County current and former employees:

Margaret Stapleton
Ric Barrick
Leslie Stout
Robert Nadeau
Scott Carrico
Marcy Giovagnoli
Michael Jorgenson
Emmanuel Espinal

2.) Please modify the date range for the email records request to be from January 1, 2015 through December 31, 2016.

3.) Our original item 1 request from April 5, 2017 remains as is. To repeat, this request was for "All contracts, maintenance agreements, bid proposals, purchase orders, invoices, reconciliations, vendor performance evaluations and/or other documents involving Pro Sound & Video, Inc. that were administered by the Broward County Office of Public Communications from January 1, 2015 through March 31, 2017."

In your May 1st response you indicated that some records may be exempt from public inspection. When responding to this letter with a revised fee estimate please elaborate on this statement, specifically addressing these questions:

1.) Under what Sunshine Law exemptions would the records being requested be withheld and/or redacted?

2.) Will you provide an explanation and/or summary of any records that are withheld and/or redacted?

3.) Will you provide a list of Broward County staff members who reviewed the records and made the decision to withhold, redact or exempt any records?

4.) Is there an appeal process in place at Broward County for challenging the decision to exempt records and if so what is this process?

Finally, we noticed the May 1st letter came from Margaret Stapleton, one of the individuals included in the records request. In order to avoid the appearance of any conflict of interest would it be appropriate for the eight employees identified in this request who are still employed with the County to recuse themselves from any involvement in the records review?

Thank you for your assistance.

Please check your records as I show that this public record request has been fulfilled. The three fulfillment emails are actually contained in the email thread below. The first email had all the electronic documents attached to it. The second and third emails were intended to contain mp3 audio recordings of negotiation meetings, but I was unable to send them electronically because the files were too large; thus they were mailed to your Muckrock address the same day.

Please recheck your files and let me know if you did not receive the items as submitted.

Hello, it appears that we have not received the CD you said was mailed. We'll check again but can you tell us if the CD was shipped via a method that provided a tracking number, such as Fed Ex, UPS or USPS Priority Mail, and if so, what is the tracking number?

RE: Public Records Request requests@muckrock.com

On April 5, 2017 we made a public records request for the following items:

1) All contracts, maintenance agreements, bid proposals, purchase orders, invoices, reconciliations, vendor performance evaluations and/or other documents involving Pro Sound & Video, Inc. that were administered by the Broward County Office of Public Communications from January 1, 2015 through March 31, 2017.

2) All emails, memorandums, written correspondence and related documents from the following Broward County employees, elected officials and Pro Sound & Video, Inc. staff where Pro Sound (and its name variations, see below) appears in the subject line and/or body of text. The date range for this request is from January 1, 2015 through March 31, 2017.

On May 1, 2017 we received a cost estimate of $241.00 to process this request. On June 26, 2017, in order to lower the cost estimate and decrease the amount of County staff time required to fulfill our request, we revised our request as follows:

On July 13, 2017 you sent us a revised estimate of $75.00 to fulfill the modified request and we mailed a check for this amount on August 10, 2017.

On October 13th and 26th 2017 you indicated that our public records request has been fulfilled. However according to our records this records request has only been partially fulfilled as of November 9 2017.

The only items we have received to date appear to be related to this part of the request: All contracts, maintenance agreements, bid proposals, purchase orders, invoices, reconciliations, vendor performance evaluations and/or other documents involving Pro Sound & Video, Inc. that were administered by the Broward County Office of Public Communications from January 1, 2015 through March 31, 2017.

We have no record of Broward County fulfilling the first part of our modified request, emails that contained a reference to Pro Sound Inc. during the time frame of January 1, 2015 and December 31, 2016 from these eight Broward County current and former employees:

Margaret Stapleton
Ric Barrick
Leslie Stout
Robert Nadeau
Scott Carrico
Marcy Giovagnoli
Michael Jorgenson
Emmanuel Espinal

Therefore, please provide the emails as soon as possible. If you believe we are in error and the emails were provided please indicate when and how they were delivered because none of the fulfillment letters we have received from you indicate that the email records request was fulfilled even though our June 26, 2017 email clearly indicated that the emails were still part of our records request.

Thank you.
