I also request that all fees be waived as I am a journalist -- employed by the Boston Globe and MuckRock -- and intend to use the requested information to educate the public.

I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Yul-mi,

Thank you for the documents you provided, but as you pointed out in your earlier correspondence they are not the documents I requested. You wrote in your Nov. 4 letter that the "Seized Asset Logbook" contains exempt material -- namely the names of persons -- and is therefore exempt from disclosure.

But Massachusetts law requires that the custodian of a record, when reasonable, redact exempt portions of a public document in order to properly disclose the non-exempt portions of that same document. Police, for instance, redact names and identifying information from arrest reports before releasing the rest of the document.

I have seen seized asset logbooks from several other district attorney's offices. Unless the Bristol County logbook id drastically different, it should be organized similarly to an excel spreadsheet -- with all the names and other identifying information in columns. I therefore ask that you redact personally identifying information and provide me with the material that is a public record.

I am primarily interested in the dollar amounts for each seizure, the date, and the agency that seized the assets.

I have not seen how other district attorneysโ€™ offices keep their seized fund logbook. Thus I cannot say whether our information is kept differently from theirs.
Regardless, I do not believe that we are in a position to send you any additional material.
