Hello,

I have a separate issue regarding a conflict in an oral ruling and a written order for cases 05-2020-CF-040351-AXXX-XX, 05-2020-CF-040369-AXXX-XX, 05-2020-CF-040371-AXXX-XX, 05-2020-MM-050949-AXXX-XX, 05-2022-MM-28459-AXXX-XX.

The cases were transferred to Seminole County due to a potential conflict of interest, but when I make contact to address any issues, I’m directed to the Brevard Clerk of Court.

The conflict amounts to the oral ruling is as follows:

“The Court does order you in
these –- in this case to follow any orders of the Court as they pertain to injunctions or family sharing plans.” Page 21 of the attached transcript.

The written order states something only the family sharing plans.

If the attached transcript and my message could be added to the relevant cases, I’d appreciate it. Thank you.

The above is from the final judgment in case # 05-2017-DR-054881. For whatever reason the clerk of court office zeroed out these amounts as if they had been paid. Why doesn’t the negative arrearage still reflect?

The response provided by Mrs. Cheatham did not answer my question. I apologize if I was at all unclear, but I’m seeking clarification on why the statement of arrears does not reflect a negative arrearage for December of 2017 until August 30, 2018 and August 31, 2018 until August 18, 2020.

Additionally, the attorney of record listed for myself in case # 05-2017-DR-054881 and case # 05-2020-DR-036701 is permanently retired and unable to practice law.

The “statement of arrears” is listed on BECA. I’ve included a pdf listing the current statement of arrears.

If the above is true, then why is the amount of arrears for December of 2017 until August 30, 2018 and August 31, 2018 until August 18, 2020 not listed?

Does the applicable final judgment state the arrears are not to be paid through the court or State Disbursement Unit? The final judgment says nothing concerning how the arrears are to be paid. It calculates the arrears that are due from 12/2017-8/2020, and that’s it.

1. “ MR. LOCKE:· I think -- I'd have to sit and do the math, but as of -- I think we kind of went over this at the first trial, too. As of -- gosh, sorry December 10th of 2021, she had been a total of $16,095. Up until that point, I had been ordered to pay her $12,800. So, even to take into account whatever they're saying, I'm still ahead whatever -- I think it's, like, $2,300. I think that's what she's been paid in excess of. And then kind of what I was saying in trying to explain the -- whatever, in the messages ·regarding the -- our son's medical appointment, is that she has enough -- like, she's ordered to pay me for the surplus arrearage from child support, ·$110 each month.· She hasn't been paying it for January, February, and March. And then also, she was paid an excess in child support because, like, the -- because the order wasn't signed until March or whatever, but for January, February, and March, I was technically ordered to pay $1,057.75 a month and because the order hadn't been signed, I was having to pay 1,357.75, and that's what she received. So, now there's going to be another arrearage of, like, roughly, $900. So, all told, she's still, like, ahead, whether it be child support or equalizing payments, at like, almost ·$4,000. It's like a surplus that she's received.” pages 69 and 70 of the attached transcript.

2. An order entered on 6/13/2022 in case 05-2017-DR-054881 states “Funds paid through the state disbursement unit are specifically categorized as child support and are not to be included in the equalizing payment calculation.”
