Pursuant to the Massachusetts Public Records Law, I hereby request the following records, all of which were provided to the Ripples Group as stated on page 9 of the "Strategic Plan for Women Who Are Incarcerated in Massachusetts:"

- A database of currently incarcerated women at MCI-Framingham, including age, race, offense, sentence, zip code of home community, number of children reported by women (no names)
- A database of staff at MCI-Framingham, including positions, gender, race (no names);
- Historical breakdown of the population at MCI-Framingham by sentence types (i.e., state/county/pre-trial/civil/federal);
- Program participation and visitations at MCI-Framingham;
- Financials on MCI-Framingham.
- other reports and files, many related to facility conditions.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

The Division of Capital Asset Management and Maintenance ("DCAMM") received your public records request dated July 5, 2022.

You requested:

We attach the database of currently incarcerated women at MCI-Framingham, with names excluded. We also commend you to the following site where you will find a substantial number of requested records which are publicly available: https://www.mass.gov/research-statistics-and-reports.

At this time, we are withholding draft facility condition reports pursuant the Deliberative Process Exemption set out at G.L. c. 4, § 7(26)(d) ("Exemption (d)"). The subject reports, on which ongoing policy position development is or may be based, are incomplete and in draft form at this date and therefore exempt from mandatory disclosure. Exemption (d) is intended to avoid release of materials that could taint the deliberative process if prematurely disclosed. We have not been informed of the anticipated completion date at this time. We suggest you contact us in four to six weeks if you have a continued interest in the facility condition reports.

Furthermore, we are currently withholding records relating to staff at MCI-Framingham pursuant to Massachusetts General Laws Chapter 4, Section 7(26)(n) which reads as follows:

Exemption (n) applies to: records, including, but not limited to, blueprints, plans, policies, procedures and schematic drawings, which relate to internal layout and structural elements, security measures, emergency preparedness, threat or vulnerability assessments, or any other records relating to the security or safety of persons or buildings, structures, facilities, utilities, transportation, cyber security or other infrastructure located within the commonwealth, the disclosure of which, in the reasonable judgment of the record custodian, subject to review by the supervisor of public records under subsection (c) of section 10 of chapter 66, is likely to jeopardize public safety or cyber security.

The withheld records include identity of security staff and implicates security, policy and procedure measures the knowledge of which could threaten security or safety of persons working or visiting Commonwealth women's correctional facilities, the very records which are the focus of the exemption. See People for the Ethical Treatment of Animals, Inc. v. Department of Agricultural Resources, 477 Mass. 280 (2017) at 289 (requiring a determination whether and to what degree the record sought resembles the records listed as examples in the statute). Specific knowledge of security staff and security measures exposes the public, inmates and these valuable Commonwealth assets to threat actors and jeopardizes physical security. It is therefore the determination of this office that disclosure of the redacted portions of the subject record is likely to jeopardize public and security.

The balance of the requested is under review and may be exempt from disclosure. We anticipate delivery of that material, if determined to be non-exempt, in the next few weeks and appreciate your understanding given the sensitive nature of this important work.

If you wish to challenge any aspect of DCAMM's response, in accordance with G.L. c. 66, § 10 and 950 CMR 32.00, you may appeal to the following office: Supervisor of Public Records, Office of the Secretary of the Commonwealth, Public Records Division, One Ashburton Place, 17th Floor, Boston, MA 02108, and in accordance with G.L. c. 66, § 10A(c), you have the right to seek judicial review of an unfavorable decision by commencing a civil action in the Superior Court.
