To Whom It May Concern:

Pursuant to North Dakota Constitution, Article XI, Section 6, and the North Dakota Open Records Statute, N.D.C.C. ยง 44-04-18(1), I hereby request the following records:

I have obtained via a separate records request, an audio file made between an Investigator Pittman and Kevin Nason of Ward County Sheriff's Office which occurred on October 10th 2013 and concerned an incident which had occurred on the previous day, October 9th 2013. This incident occurred in Bismarck. The incident in question occurred when bounty hunters tracked down a man who was out on bond, had picked up another warrant, but the bond stayed in effect; he wasn't supposed to be brought back in in other words. The man's father was Jonathan Condos (other possible spellings could be Kondos). The incident involved a broken leg and a punch to the gut that was so forceful it caused the man to vomit. The names involved in the incident are John (could also be Jon or Jonathan unsure from the audio) Clark, Tiffany Norton, and Tyler Schnase. From the audio, I gathered it was Mr. Clark (could also be Clarke) who was doing the bond recovery operation.

For this request I seek:

-Any incident reports concerning this incident.
-Any other reports or intelligence gained about this rogue bounty hunter that came as a result of following up on this incident.
-Any communications including emails from 10/1/13 to 1/1/14 that reference any of the above names, or the keywords "bounty hunter," "Bail recovery agent," or "bail enforcement agent."

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Sincerely,

Curtis Waltman

Okay, I understand. I do think I got the name wrong from the man from Ward County Sheriff, it was Mike Nason not Kevin. It is a small detail I know. I find it odd that there are no records, the audio recording was quite clear. Might they have been gotten rid of due to the retention schedule for those documents passing the expiration date? I appreciate your work on my request, thank you. I have also inquired with Burleigh County SD as well.

Sincerely,
Curtis Waltman

Mr. Waltman,

I do not have anything for Mike Nason either. We do not get rid of our reports, so I should be able to find it if our agency was the one that handled the case. I am not finding a report under any of the names for that date in our records system.

Thank you for your request.

It must be with Burleigh County then. Are there any reports from that date at all? October 9th or 10th? I guess it is possible I was not able to understand their names from the audio. I don't mean to be a bother though, thank you very much for your diligence on this request, I really appreciate the work you do. Have a great day.

Sincerely,
Curtis Waltman
