I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

If necessary, we will notify you that we require the additional 15 days allowable under Massachusetts Public Records laws to complete your request.  If there will be a charge to fulfill your request we will provide you with a good faith estimate. The fee will include costs for labor that exceeds 2 hours. If you consent to the cost, you must authorize the Town to proceed with the research on the promise that you will pay the actual amount due. Payment of the fee must be received prior to delivery of the records. Please note that the Commonwealth schedule for reimbursement of expenses related to a Public Records Request follows:

* $.05 per page – print or copy

* the actual reproduction cost for unique items such as full-size plans or maps

* plus the wages of the lowest-paid employee who can perform the research/copying or redacting work – the first two (2) hours are free.  The maximum rate allowed to be charged is $25.00 per hour.  

* if exemptions, additional fees or time are required, the Town will petition the Supervisor of Public Records

Please be advised that you have the right of administrative appeal to the Massachusetts Supervisor of Records under 950 CMR 32.08(1), and the right to seek judicial review of any unfavorable decision by commencing a civil action in the superior court pursuant to M.G.L. c. 66, §10A (c).
