To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I am a reporter with DIG Boston. I am looking to access the labor/union contract of Lt. Rick Pedrini. I am also looking to access any incident reports regarding Lt. Rick Pedrini since 2000, any documents related to his ethics investigation and its outcome with the Town of Arlington in 2018/2019 subsequent to his fall 2018 publications in the Sentinel, and any complaints that may have been filed regarding potential professional standards violations (as noted here: https://www.arlingtonma.gov/departments/police/about-apd/professional-standards) committed by Lt. Rick Pedrini since 2000. Please let me know if you have any questions or need any additional information. Thank you for your consideration.

Sincerely,

Laura Kiesel

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Laura Kiesel

From: Arlington Police Department

Good afternoon Laura Kiesel,

Thank you for submitting via electronic mail to Suzanne Santorelli of the
Arlington Police Department the above-referenced Public Records Request on
March 21, 2019. I was forwarded your request as Arlington's Records Access
Officer. In accordance with G.L. c. 66 § 10 and the regulations enumerated
in 950 C.M.R. 32.00: Public Records Access, please allow this correspondence
to serve as the requisite written response.

The collective bargaining agreements with the Arlington Ranking Officers
Association are readily available and attached hereto in response to your
request.

The Town of Arlington has searched for and compiled a series of records
satisfying the other categories and/or criteria listed in your request. This
series of potentially responsive records contains information that may be
specifically exempted, protected or privileged, requiring careful
examination to determine which records or portions thereof are subject to
redaction or withholding. Due to the level of difficulty of the requisite
review, and in order to prevent the unlawful release of sensitive
information, the review will need to be performed by outside Counsel, who
will perform any necessary segregation and redaction of the records.

As a result of the difficulty of this request as outlined above, the Town
will require additional time to produce the responsive records. Accordingly,
consistent with the relief provided for in G.L. c.66 §10(b)(vi), the Town
intends to produce the non-exempt records or portions thereof on or before
Wednesday, April 10, 2019. Please also note the Town intends to provide
these records electronically and at no cost. Should the records become
available sooner, they will be transmitted prior to the foregoing deadline.

If you are aggrieved by this response, you may seek redress through the
administrative appeal process provided for by the Supervisor of Records as
outlined in 950 C.M.R. 32.08, as well as the judicial remedy provided for by
the Superior Court as outlined in G.L. c. 66 § 10a. For more information,
please visit the Secretary of the Commonwealth of Massachusetts website:
www.sec.state.ma.us.

Please do not hesitate to let me know if you have any questions.

Sincerely,

Jim
