Pursuant to the Arkansas Freedom of Information Act, I hereby request the following records:

I am requesting a spreadsheet of all excess emissions reports — including those due to upsets, startups, shutdowns, and malfunctions — submitted to the Arkansas Department of Environmental Quality since January 1, 2000.

Facilities are required to submit notification of excess emission events as described under Reg. 18.1004 of the Arkansas Air Pollution Control Code among other statutes. The notices are typically filed with the agency through the State and Local Emissions Inventory System, or SLEIS.

At a minimum, the information provided must include the following details:
Name and unique identifier for the facility
Date emission report was submitted
Date of emission occurrence
Quantity of total emissions
Type of primary pollutant
Quantity of primary pollutant emissions
Secondary pollutant
Quantity of secondary pollutant emissions
Cause of emission event

I prefer to receive this information as a spreadsheet (XLS, XLSX, or CSV file) but am willing to accept other machine-readable formats. If the information is not available as a spreadsheet, please contact me to discuss other options.

I am only requesting publicly available information. Please exclude confidential business information.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Arkansas Freedom of Information Act specifically states that “all public records shall be open to inspection and copying by any citizen of the State of Arkansas.” Ark. Code Ann. § 25-19-105(a)(1)(A).

In the absence of any records demonstrating your citizenship or the appropriate registration of your company to do business in the State of Arkansas, such as registration to pay Corporate Income tax on revenue derived from Arkansas business or registration with the Secretary of State’s Office as a foreign corporation doing business in Arkansas, the Division of Environmental Quality must deny your FOIA requests.
