Pursuant to the California Public Records Act, I hereby request the following records:

Responding officer body camera footage of Tamisha Torres-Walker's October 3, 2021 encounter with APD. This incident is no longer under investigation.

To be clear, I am seeking body camera footage only.

If this is unable to be released, indicate which portions of the request are unable to be released, and the specific reason.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

This was not a duplicate request. There is clearly something in the original request that the department has determined to be privileged. I am specifically requesting the body camera footage only.

If this is privileged, state the specific reason, not just the code. California state law makes it clear, 45 days after an incident, the body camera footage MUST be released upon request, with few exceptions. Please state the specific exception(s) or release the footage.

Good morning,

Although the City has fulfilled its obligations under the California Public Records Act with regard to your request, it will provide the following information to address your follow-up questions. The requested video is an investigatory record exempt from disclosure pursuant to the statute cited in the response letter. In cases involving a “critical incident,” a State law commonly known as SB 1421 specifically supersedes this exemption for certain records after the investigation is complete, although records may be withheld for the reasons provided by the statute. In this case, the requested record does not pertain to a critical incident as defined by SB 1421, and the record remains exempt.
