Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following documents:

A record or spreadsheet showing the dollar amounts spent on SRO (School Resource Officers) salaries, of those who work at Manzano HS; as well as the amount spent on security systems such as cameras, metal detectors, motion sensors, etc. at the same school.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Below is are two letters I sent you via e-mail and U.S. Mail on Dec. 11, 2015, and asking that you provide more information to be able to process your requests for information. As of this date I have not received a reply to either letter.

Nancy Chavez of the APS Superintendent's Office sent me a copy of an e-mail she received today regarding that request. You can call me with the information or write directly to me at the address below. She provided your e-mail to me as the custodian of records for Albuquerque Public Schools.

Dear Mr. Stacy:

This letter is in response to your e-mails received Dec. 7, 2015 and Dec. 11, 2015, and my e-mail sent Dec. 7, 2015, regarding your request for documents under the NM Inspection of Public Records Act related to funds spent on School Resource Officers assigned to Albuquerque Public Schools Manzano High School.

Your e-mail received this morning with the subject line: "Budget for Art Programs and Classes at Manzano HS" actually was the same e-mail as the one you had sent with the subject line: "Spending on APS Resource Officers and Security Systems at Manzano HS." I had received a similar e-mail regarding art programs and classes at Manzano High School on Dec. 7, so I am responding to that one.

With regard to your request for "a record or spreadsheet showing the dollar amounts allocated int (sic) the overall budget for Art-related classes (Newspaper, Journalism, Yearbook, Photography, Art, Ceramics, Drawing and Painting, Computer Graphics, Digital Film Production, Drama) specifically," I have asked administrators at Manzano High School for any records responsive to this request however, it would be helpful if you could provide a range of dates that you are interested in regarding this expenditure information. Please let me know the dates you are interested in.

Should you want copies of any documents located, the district charges $.50 (50 cents) per page.

With regard to your request that any charges be waived, that request is denied.

With regard to your request that any documents located be provided electronically, if a document is available electronically, I can provide it in an electronic format. Under the NM Inspection of Public Records Act, public entities are not required to create documents in response to requests for information: "14-2-8. Procedure for Inspection... B. Nothing in the Inspection of Public Records Act shall be construed to require a public body to create a public record." Further, according to the "New Mexico Inspection of Public Records Act Compliance Guide (Eighth Edition - 2015 (Page 32))" put out by the New Mexico Attorney General's Office, "The right to inspect applies to any nonexempt public record that exists at the time of the request. A records custodian or public body is not required to compile information from the public body's records or otherwise create a new public record in response to a request."

If the documents located are too large to be sent electronically, I can make a copy and provide them to you on CD. The district charges $5 per CD for CDs made in response to request received under the Act.

You should be aware that if the officer or officers assigned to Manzano High are actually employed by the city of Albuquerque Police Department, you will need to ask the city for records related to their salaries or employment.

With regard to your request for "the amount spent on security systems such as cameras, metal detectors, motion sensors, etc. at the same school (Manzano High)," I can ask both the APS Police Department and Manzano High School for any records responsive to this request, however, it would be helpful if you could provide a range of dates that you are interested in. Please let me know the dates you are interested in.
