Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following documents:

Please provide me with all records pertaining to the police response to the shooting perpetrated by Christopher Thomas Chase on 10/26/2013. The records I am requesting include but are not limited to incident reports and discharged round reports.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Please be advised upon further review, we have determined your request is “excessively burdensome and broad,” and my office respectfully requests an “additional reasonable period of time” to complete the request. NMSA 1978, § 14-2-10.  We will continue to update you on our progress. Finally, we will promptly contact you as soon as those documents become available for your inspection or pick up.

Your IPRA request dated September 19, 2019. Has an estimated amount of 16 supplemental reports and 2,479 pages of investigative reports. My office has yet to print out a copy to conduct redactions; however we are estimating our anticipated copying costs will be an estimated amount $1289.50 (five pages  per report). Please provide payment of at least $500.00, and then we will provide that exact amount of copied documents for your pick-up or we can mail the documents to your previously listed address. However, we also have the right to charge for the mailing costs. All government entities “may require advance payment of the fees before making copies of public records.” NMSA 1978, § 14-2-9(5) The right of “advance payment” functions to ensure that government resources (e.g. copying and mailing costs) are not needlessly expended without compensation while attempting to satisfy IPRA requests.  We will require advance payment for your public records request. Once the check is received and processed, then I will contact you and provide you further details in order to finalize the remainder of your request.

 

If you are seeking to inspect the responsive records at no cost, please notify my office as soon as possible. The inspection will take place at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. That office is located on the 7th floor of that building. Even though your inactions may force my office to close this request, you are always welcome to resubmit a new request in the future.
