Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Subject: Freedom of Information Law (FOIL) Request – Invoices and Itemized Receipts for the Construction of Clinton Market Collective

Dear Records Access Officer,

Pursuant to the New York State Freedom of Information Law (FOIL), Article 6 of the Public Officers Law, I am requesting access to and copies of all invoices, itemized receipts, and financial records related to the inception, planning, design or construction of the Clinton Market Collective project located at 11 Clinton Avenue in Albany, New York. The construction of this project is supported by more than $3.5 million in local, state, and federal assistance.

The Clinton Market Collective project is being carried out by the following entities:

Schenectady-based landscape architecture firm PLACEAlliance as the designer.
Construction management services are being provided by TW&A.
Construction is being led by James H. Maloy, Inc.

The funding for this project comes from various sources, including the New York State Department of State, the City of Albany as part of its American Rescue Plan Act funding process, National Grid, and Capitalize Albany Corporation.

Please provide me with all invoices and itemized receipts for this project from its inception to the present. If any of the requested records cannot be disclosed, please cite the specific exemptions under FOIL and provide me with any segregable portion of the record.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I am writing in response to your recent correspondence regarding my Freedom of Information Law (FOIL) request, reference number W019388-050823, regarding the invoices and itemized receipts for the inception, planning, and construction of the Clinton Market Collective project.

Firstly, I appreciate your prompt response and the documents you have made available electronically via the online portal. I will be reviewing these in detail.

However, I note that some of the documents requested have been denied on the basis that the record is not maintained by your agency. Given the public nature of the project and the various sources of funding, including local, state, and federal assistance, I am surprised to learn that these records are not maintained by the City Clerk's office.

Could you please clarify which specific documents or types of records are not maintained by your agency? This clarification will assist me in directing my request to the appropriate agency or department. Also, if you could provide any guidance on which other agencies or departments might maintain these records, I would greatly appreciate it.

Moreover, I am considering appealing the decision to partially deny my request. As such, could you please provide any additional information that would be helpful in formulating my appeal, such as the specific sections of the FOIL that were used to justify the denial of these records?
