I am writing to appeal the agency's response to my FOIL request (#[request number]) dated March 5, 2023. In the agency's response, it was stated that only kindergarten enrollment data for the past ten years by school year was provided, but the other requested data related to birth rates, birth to kindergarten survival ratios, and any communications with government agencies regarding this data was not provided.

Furthermore, the provided data only includes summary data and not the source data requested in the original FOIL request. The request specifically asked for live birth data including constant birth rate, long term, short term and average birth rates for within the district for current and previous six years, birth to kindergarten survival ratio used for the past 10 years by year, and projected kindergarten enrollment for the past 10 years by year, along with supporting data.

Given this information, I respectfully request that the agency reevaluate my FOIL request and provide all the requested data in a source data format. Additionally, I request any communications with NYS DOH or County DOH or other data service provider requesting, receiving or inquiring regarding live birth data, birth to kindergarten survival rate or other statistical data used for projecting enrollment.

As a reminder, FOIL requires that requests for records be granted or denied within five business days of receipt of a request. If access to any records is denied, please provide a written response detailing the reasons for denial.

Thank you for your attention to this matter. I look forward to receiving a response to my appeal within five business days.
