Any reports, interviews, or similar investigative material in the department’s possession related to Sustained Incidents of Sexual Misconduct, or Sustained Incidents of Dishonesty. Apologies if you already have this information posted to your website to comply with SB 1421 but I do not seem to be able to find it posted.

In response to the California Public Records Act (CPRA) request dated March 21, 2024:

You requested 'Any reports, interviews, or similar investigative material in the department's possession related to Sustained Incidents of Sexual Misconduct, or Sustained Incidents of Dishonesty.'

The City has determined that your request includes a voluminous amount of responsive individual records, all of which would have to be reviewed to ensure that they are indeed within the scope of the request and then for the presence of exempt material prior to disclosure. As such, the request is not sufficiently focused, is unduly burdensome and must be narrowed before the City can respond. (Cal. Gov't Code § 7922.600). Under the Public Records Act, the City is obligated to produce documents upon a request that "reasonably describes an identifiable record" (Cal. Gov't Code § 7922.530(a)) such that the record or records "can be located with reasonable efforts" (State Board of Equalization v. Superior Court, (1992) 10 Cal.App.4th 1177, 1186), and which is sufficiently "focused and specific." (Rogers v. Superior Court, (1993) 19 Cal.App.4th 469, 481). Even a clearly framed request will be objectionable as unduly burdensome if it requires the agency to review an enormous volume of data in order to segregate exempt and nonexempt material. (American Civil Liberties Union Foundation v. Deukmejian, (1982) 32 Cal.3d 440, 444; California First Amendment Coalition v. Superior Court, (1998) 67 Cal.App.4th 159, 166.). To assist you in providing a more focused request, the City recommends that you narrow the timeline and/or provide keyword search terms to assist the City in more quickly and efficiently identifying, reviewing and producing responsive records.

Some of the information contained in the enclosed records you requested is exempt from disclosure pursuant to Government Code section 6255. Portions of the documents provided have been redacted to preserved the privacy of individuals.

If you believe the records provided are outside the scope of your request, if we inadvertently misconstrued your request, or if you have additional questions regarding your request, please contact the City Clerk Department at (562) 567-9850.
