All emails or any other form of written communication, planning, preparation and execution documents generated regarding your agency’s involvement in the Wednesday, January 6, 2021 violent attack at the United States Capitol.

All emails or any other form of written communication, planning, preparation and execution documents generated regarding the 59th Presidential Inauguration on Wednesday, January 20, 2021.

In order to help to determine my status to assess fees, you should know that I am a representative of the news media affiliated with cable news network Newsy.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In response to your FOIA request, EOM offered to provide you with access to an all-encompassing search of District-wide emails concerning the insurrection on January 6, 2021. The results of this search are broader, but overlap with your request. I have attempted to reach you on 2/2/22 and 2/14/22, at the email and phone number you provided on your FOIA request, to receive a response from you about whether you would accept or reject the larger 1/6 production. Over the course of thirty (30) days I have not heard back from you for these reasons, your FOIA will be closed due to a lack of response on your end. In place of your FOIA request, I have provided you with access to the larger 1/6 production at the email address listed on your FOIA request.  I have determined that documents and portions of documents in the larger 1/6 production that have been sent to you should be withheld pursuant to: 2-534(a)(2), “Personal Privacy” - Information of a personal nature where the public disclosure thereof would constitute a clearly unwarranted invasion of personal privacy; 2-534(a)(3)(A)(i), "Investigatory Records/Enforcement Proceedings" - Investigatory records compiled for law-enforcement purposes, including the records of Council investigations and investigations conducted by the Office of Police Complaints, but only to the extent that the production of such records would interfere with Enforcement proceedings; 2-534(a)(3)(E), "Investigatory Records/ Investigative Techniques" - Investigatory records compiled for law-enforcement purposes, including the records of Council investigations and investigations conducted by the Office of Police Complaints, but only to the extent that the production of such records would disclose investigative techniques and procedures not generally known outside of the government; 2-534(a)(3)(F), "Investigative Records/Endanger Law-Enforcement Personnel" - Investigatory records compiled for law-enforcement purposes, including the records of Council investigations and investigations conducted by the Office of Police Complaints, but only to the extent that the production of such records would endanger the life or physical safety of law-enforcement personnel; 2-534(a)(10), “Emergency Response Plan” - Any specific response plan, including any District of Columbia response plan, as that term is defined in § 7-2301(1), and any specific vulnerability assessment, either of which is intended to prevent or to mitigate an act of terrorism, as that term is defined in § 22-3152(1); and 2-534(e), Deliberative process privilege, attorney work-product privilege, and/or attorney-client privilege.
