This is a Freedom of Information Act and Privacy Act request pursuant to Florida Sunshine Law.

I am hereby requesting the below information regarding Volusia County Building & Code Administration's policies, procedures, and guidelines with regards to disconnection of utility services to customers of Duke Energy Corporation, Deland, Florida.

Please provide the following information as it pertains to Volusia County Building & Code Administration's requests for disconnecting existing electrical utility service, source of energy, fuel or power, to customers of Duke Energy Corporation, Volusia County:

1) Written guidelines, including the relevant sections of Florida Building Code(s) and Volusia County Municipal Code of Ordinance, authorizing a utility disconnection by Code Enforcement officials.
2) Standard operation procedures followed when requesting the disconnection of utility service, energy, fuel or power to customers of Duke Energy Corporation, Volusia County.
3) The basis for establishing a reasonable cause of action or determination for disconnecting utility service, energy, fuel or power by Code Enforcement officials to customers of Duke Energy Corporation, Volusia County.
4) The number of disconnect requests that have been made to Duke Energy Corporation by Volusia County Building & Code Administration for the period January 1, 2022 through present.
5) The property addresses where disconnect requests have been made by Volusia County Building & Code Administration to Duke Energy Corporation, Volusia County, and the ticket numbers.
6) The number of Notices of Violation, Notice of Hearings, and Stop Work Orders that have been issued in relation to Code Enforcement requests for utility service power disconnects, for the period January 1, 2022 through present, and the corresponding case numbers.
7) The name of the Code Enforcement building official(s) who have signed off on the disconnect requests to Duke Energy Corporation, Volusia County.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge, processed by a representative of the news media/press, and is not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

I would prefer the request be filed electronically, by e-mail attachment if available.

Should my request be refused, kindly provide the specific legislative citation for the rejection, as required by Section 119.07(1)(d) of the Florida Statutes.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within a reasonable time frame, according to Section 119.07(1)(a),(c) of the Florida Statutes.

Good afternoon Ms. Gonzalez,

Your requests have been idle for over 2 weeks due to non-payment. If we do not receive payment from you in 1 week from today, all requests will be considered null and void. You will then need to resubmit your requests again to be reevaluated and new fees assessed.

Please find attached an estimate of the fees associated with producing records responsive to your request. Charges are in keeping with Title X, Chapter 119 of the Florida Statutes. If you would like to proceed with the attached estimate, please let us know. Payment must be received before the final search is performed and the records are reviewed for exempt and/or confidential information.

You may also pay by phone by calling the Treasury and Billing office at 386-943-7085, explaining that you are paying a public record request fee and providing the reference number starting with PRR that can be found in the subject line of this email. If paying by debit or with credit card a payment processing fee is charged and retained by our third-party payment processor. The fee for pin debit transactions is $1.95 and the fee for credit transactions is 2.6% with $1.95 minimum charge.

Your requests have been idle for over 2 weeks due to non-payment. We have received no response, nor any attempts at payment. We will be closing this request now due to this and if you would like to still have these records you will need to request the records again, and we will go through the process again. This will start the process all the way over and you will be at the back of the line due to this.
