Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

Related to the use of dynamic tolling, High Occupancy Toll lanes, or equivalent dynamic pricing on roadways under the jurisdiction of this agency:

- A map or equivalent locational reference for roadways and areas currently implementing or expected to implement dynamic tolling

- Materials regarding data points taken into consideration as part of the dynamic tolling algorithm or program

- Any available copies of the calculation/algorithm used

- Any and all available reports regarding the pricing of tolls by time of day on affected roadways

- Any and all policies guiding the use and implementation of dynamic tolling or equivalent variable pricing systems on roadways under the jurisdiction of this agency

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Virginia Department of Transportation received your Freedom of
Information (FOIA) request for certain tolling related records. Please be
advised section 2.2-3704 (A) of the Code of Virginia grants rights of
access to public records to citizens of the Commonwealth. Since you are a
citizen outside of the Commonwealth, we are denying your request for
records. If you have a valid Virginia mailing address, please provide that
information so that we may proceed with your request.

For your reference, I am providing you a copy of section 2.2-3704 (A) of
the Code of Virginia below.

CODE OF VIRGINIA

ยง 2.2-3704. Public records to be open to inspection; procedure for
requesting records and responding to request; charges; transfer of records
for storage, etc.

A. Except as otherwise specifically provided by law, all public records
shall be open to citizens of the Commonwealth, representatives of
newspapers and magazines with circulation in the Commonwealth, and
representatives of radio and television stations broadcasting in or into
the Commonwealth during the regular office hours of the custodian of such
records. Access to such records shall be provided by the custodian in
accordance with this chapter by inspection or by providing copies of the
requested records, at the option of the requester. The custodian may
require the requester to provide his name and legal address. The custodian
of such records shall take all necessary precautions for their preservation
and safekeeping.
