Pursuant to Virginia Freedom of Information Act, I hereby request the following records:

All records reflecting communications (including emails and telephone logs) between Virginia Department of Transportation staff and David James "DJ" Gribbin. Please restrict this search to January 1, 1997 through December 31, 2007.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

The Virginia Department of Transportation received your Freedom of Information (FOIA) request for records reflecting communications (including emails and telephone logs) between Virginia Department of Transportation staff and David James "DJ" Gribbin from January 1, 1997 through December 31, 2007. Please be advised section 2.2-3704 (A) of the Code of Virginia grants rights of access to public records to citizens of the Commonwealth. Since you are a citizen outside of the Commonwealth, we are denying your request for records. If you have a valid Virginia mailing address, please provide that information so that we may proceed with your request.

For your reference, I am providing you a copy of section 2.2-3704 (A) of the Code of Virginia below.

CODE OF VIRGINIA

§ 2.2-3704. Public records to be open to inspection; procedure for requesting records and responding to request; charges; transfer of records for storage, etc.

A. Except as otherwise specifically provided by law, all public records shall be open to citizens of the Commonwealth, representatives of newspapers and magazines with circulation in the Commonwealth, and representatives of radio and television stations broadcasting in or into the Commonwealth during the regular office hours of the custodian of such records. Access to such records shall be provided by the custodian in accordance with this chapter by inspection or by providing copies of the requested records, at the option of the requester. The custodian may require the requester to provide his name and legal address. The custodian of such records shall take all necessary precautions for their preservation and safekeeping.

I'd like to update my request to include the following:

(1) All email communications between the "DOT Materials Division", "DOT Scheduling & Contract Division", and the "DOT Innovative Project Delivery Division" and email domains ending with "kochind.com".

(2) All "DOT Materials Division", "DOT Scheduling & Contract Division", and "DOT Innovative Project Delivery Division" email communications containing the word "Gribbin".

Please limit this search to 1997 - 2003.
