Pursuant to the Government Records Access and Management Act, I hereby request the following records:

I am seeking the following information from your state department of corrections:
List of inmates who identify as transgender or gender diverse (names redacted is fine) and
a. Sex assigned at birth (M/F)
b. Gender identity (M/F)
c. Race
d. Holding Offense information
e. number of transgender male, transgender female, Intersex, gender non-conforming, etc. inmates who have requested placement in institution consistent with their gender identity and status of those requests, and how many inmates currently housed in facility consistent with their gender identity.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Hello,

Thank you for your request. We appreciate your patience. Utah Code 63G-2-201(7) specifies that our agency is not required to create a record or tailor data or information in respond to a records request. However, acknowledging the public interest in the matter of treatment of transgender individuals in the context of the criminal justice/correctional system, we are providing you with some information as a onetime courtesy.

The Utah Department of Corrections (UDC) Research and Planning team has provided me with the following information to pass on to you:

-There are 4 female gender assigned at birth offenders and all 4 females identify as male
-There are 30 male gender assigned at birth offenders and all 30 of these males identify as female
-There are only 2 offenders that have requested housing with the gender they identify as. None have been granted as all housing is assigned based on the sex assigned at birth. The Utah State Legislature recently passed a bill addressing the matter of housing assignments for transgender inmates. Please see HB316 (2024).

If you wish to dispute our fulfillment of your records request, you have the right to appeal this decision to the Utah Department of Corrections’ Deputy Director. To submit a proper appeal, you must file a Notice of Appeal with the Deputy Director within 30 days of the date of this denial. The Notice of Appeal must contain your name and a copy of, or the original request, which was denied. It must also include a statement of the relief you seek (explain what you want the Deputy Director to do). You may also submit a short statement of facts, reasons and legal authority in support of your request for these records. Please include a mention of the reference number that was assigned to this GRAMA request.

To appeal this request please reply to this message with your appeal. Please also feel free to upload any relevant documents to your appeal to this request. Once we receive your appeal, this request will be reopened while the Deputy Director deliberates. You may also send your appeal through postal mail to:
