Any search should be limited to documents and data held by law enforcement or legal departments and/or its staff members, including records created or maintained by persons acting in the capacity of administrators or staff members.

This request is made on behalf of the Foundation for Individual Rights and Expression, a nonprofit and nonpartisan organization that aims to defend and sustain the individual rights of all Americans to free speech and free thought. This request concerns a matter of public interest. The records are sought for the purpose of researching and educating the public about policies affecting student journalists' ability to engage in news gathering and reporting on college and university campuses.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

The University, as a governmental entity of the State of Utah, is subject to the Government Records Access and Management Act, Utah Code sections 63G-2-101 to -901 (“GRAMA”). Records access considerations

GRAMA specifies that only those who are legal “persons” have rights under GRAMA to receive records. See id. at § 63G-2-201(7) (“a governmental entity shall provide a person with a certified copy of a record if . . .”). “Person” is defined by GRAMA as one of the following: an individual, a nonprofit or profit corporation, a partnership, a sole proprietorship, or other type of business organization. Id. at § 63G-2-103(17).

In addition, GRAMA requires that a person making a request for a record provide the person’s name, as well as the person’s mailing address; daytime phone number; and email address, if the person is willing to accept communications by email. Id. at § 63G-2-204(1). Because you, the requester, have not provided the above information associated with you or your company with your request for records, your request does not fulfill the statutory requirements for a GRAMA request.
