According to the Federal Register ( see link: https://www.govinfo.gov/content/pkg/FR-2014-04-28/html/2014-09471.htm), The Joint Integrity Case Management System (JICMS) is a customized application that CBP Office of Internal Affairs (IA), CBP Labor and Employee Relations (LER), ICE Office of Professional Responsibility (OPR), and ICE Employee and Labor Relations (ELR) use. It was developed for joint use to record misconduct, to conduct criminal and administrative investigations, and to track disciplinary actions.

1. Any records of investigations tracked by the Joint Integrity Case Management System wherein an employee or contractor of this agency was investigated for allegations of unauthorized access or inappropriate use or disclosure of information contained in any agency databases. These databases should include but are not limited to ICM, AFI, FALCON as well as third party databases/tools.

Responsive records should at the very least include the Case/prosecution status; the Allegations received and method received; and Exhibits, evidence, statements, and affidavits; and any other information gathered in the course of or relating to an integrity or disciplinary inquiry, review, inspection, or investigation of a criminal, civil, or administrative nature.

As a reporter, I am properly categorized as a news media requester for fee purposes. Additionally, because this request is being made for a journalistic (rather than commercial) purpose, I further ask that you waive any fees for provision of the records. In support of my request for a fee waiver, pursuant to 5 U.S.C. § 552(a)(4)(iii) and 28 C.F.R. § 16.10(k)(2), I submit that disclosure of the requested information is both in the public interest and not primarily in my commercial interests.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

ICE evaluates fee waiver requests under the legal standard set forth above and the fee waiver policy guidance issued by the Department of Justice on April 2, 1987, as incorporated into the Department of Homeland Security’s Freedom of Information Act regulations [1] .  These regulations set forth six factors to examine in determining whether the applicable legal standard for fee waiver has been met.  I have considered the following factors in my evaluation of your request for a fee waiver: (1) Whether the subject of the requested records concerns “the operations or activities of the government”; (2) Whether the disclosure is “likely to contribute” to an understanding of government operations or activities; (3) Whether disclosure of the requested information will contribute to the understanding of the public at large, as opposed to the individual understanding of the requestor or a narrow segment of interested persons; (4) Whether the contribution to public understanding of government operations or activities will be "significant"; (5) Whether the requester has a commercial interest that would be furthered by the requested disclosure; and (6) Whether the magnitude of any identified commercial interest to the requestor is sufficiently large in comparison with the public interest in disclosure, that disclosure is primarily in the commercial interest of the requestor. Upon review of your request and a careful consideration of the factors listed above, I have determined to grant your request for a fee waiver.
