This is a request under the Freedom of Information Act. I hereby request the following records:

All service contracts and amendments to service contracts in which the shipper makes a commitment to provide a certain minimum quantity or portion of its cargo or freight revenue over a fixed time period, and the individual ocean common carrier or the agreement commits to a certain rate or rate schedule and a defined service level, such as, assured space, transit time, port rotation, or similar service features. The contract may also specify provisions in the event of nonperformance on the part of any party.

The requested documents will be used for research purposes and are not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This acknowledges receipt of and responds to your Freedom of Information Act (FOIA) request below filed with the Federal Maritime Commission (Commission), on June 1, 2015. Your request, pursuant to the Commission rules at 46 C.F.R. §503.31-34, seeking service contracts and amendments to service contracts filed with the Commission has been assigned FMC FOIA number 15-023. We have no record of the referenced April 30, 2015 email.

The information that you are seeking is prohibited from disclosure by the Shipping Act, 46 U.S.C. §40502(b)(1). This information is being withheld in full pursuant to Exemption 3, 5 U.S.C. §552(b)(3) of the FOIA which allows the withholding of information prohibited from disclosure by another federal statute.
Administrative appeals should be submitted to the Chairman of the Federal Maritime Commission pursuant to 46 C.F.R. §503.32. Also, the Office of Government Information Services (OGIS) offers mediation services to resolve disputes between FOIA requesters and Federal agencies as a non-exclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation.
