To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

1. "Detainee Death Review" record by the Office of Detention Oversight for Roxsana Hernández Rodriguez, whose death on May 25, 2018, while in custody in New Mexico, was widely reported in the media. See references here:
a) https://www.thedailybeast.com/trans-woman-roxsana-hernandez-rodriguez-beaten-in-ice-custody-before-death-pathologist-finds
b) https://www.nytimes.com/2018/11/27/us/trans-woman-roxsana-hernandez-ice-autopsy.html
2. All records, including emails mentioning or referring to Roxsana Hernández Rodriguez. The scope of the request is for the dates May 1, 2018 to March 23, 2019.
3. All records, including emails mentioning or referring to Roxsana Hernández Rodriguez, generated by Cibola County Correctional Center in New Mexico and CoreCivic. The scope of the request is for the dates May 1, 2018 to March 23, 2019.

I am making this request as an independent journalist with a track record of publishing with the Daily Beast, Washington Post, Associated Press, and other outlets; this request is made as part of newsgathering and not for commercial use. The requested documents will be made available to the general public. As a representative of the news media I am only required to pay for the direct cost of duplication after the first 100 pages.

Release of this information is in the public interest because it will contribute significantly to public understanding of government operations and activities, particularly the treatment of immigrants in the custody of the U.S. government. If you deny this request for a fee waiver, please advise me in advance of the estimated charges if they are to exceed $100.

If my request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the Act. I will also expect you to release all segregable portions of otherwise exempt material. I reserve the right to appeal your decision to withhold any information or to deny a waiver of fees.

I also ask that you provide expedited review of this request which concerns a matter of urgency. The information sought relates to a currently unfolding story, specifically, the ongoing border crisis caused by immigration as frequently described by President Trump. Second, delaying release of the information harms the public interest in knowing what actions are being taken to protect immigrants in the custody of the U.S. government. Third, the request obviously concerns federal government activity, as the request seeks information on the details surrounding the death of an immigrant in the custody of the U.S. government. I certify that my statements concerning the need for expedited review are true and correct to the best of my knowledge and belief.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Cristian Salazar
