Pursuant to the Freedom of Information Act, I hereby request the following records:

Any and all documents or records pertaining to the case against Jeffrey Miller a former Veterans Benefits Administration employee from Huntington West Virginia who illegally accessed the medical records of six veterans.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Please be advised that neither the Privacy Act nor the Freedom of Information Act, codified at 5 U.S.C. § 551 and 552, applies to the Judicial Branch. See 5 U.S.C. § 551(1)(B) which excludes the courts of the United States from the definition of "agency" used in § 551 et seq. of Title 5. See also United States v. Frank, 864 F.2d 992, 1013 (3rd Cir. 1988); Warth v. Department of Justice, 595 F.2d 521, 522-23 (9th Cir. 1979); Cook v. Willingham, 400 F.2d 885 (10th Cir. 1968).
