In regards to your request for afee waiver, the DHS FOIA Regulations at 6 CFR § 5.11(k)(2) set forth sixfactors DHS is required to evaluate in determining whether the applicable legalstandard for a fee waiver has been met:  (1) Whether the subject of therequested records concerns “the operations or activities of the government;”(2) Whether the disclosure is “likely to contribute” to an understanding ofgovernment operations or activities; (3) Whether disclosure of the requestedinformation will contribute to the understanding of the public at large, asopposed to the individual understanding  of the requestor or a narrowsegment of interested persons; (4) Whether the contribution to public understandingof government operations or activities will be “significant;” (5) Whether therequester has a commercial interest that would be furthered by the requesteddisclosure; and (6) Whether the magnitude of any identified commercial interestto the requestor is sufficiently large in comparison with the public interestin disclosure, that disclosure is primarily in the commercial interest of therequestor. Upon review of your request and anevaluation of the six factors identified above, DHS has determined that it willconditionally grant your request for a fee waiver.  The fee waiverdetermination will be based upon a sampling of the responsive documentsreceived from the various DHS program offices as a result of the searchesconducted in response to your FOIA request.  DHS will, pursuant toDHS regulations applicable to non-commercial requestors, provide two hours ofsearch time and process the first 100 pages at no charge to you.  Ifupon further determination that, DHS determines that the disclosure of the informationcontained in those documents does not meet the factors permitting DHS to waivethe fees then DHS will at that time either deny your request for a fee waiverentirely or allow for a percentage reduction in the amount of the feescorresponding to the amount of relevant material found that meets the factorsallowing for a fee waiver.  In either case, DHS will promptly notifyyou of its final decision regarding your request for a fee waiver. Due to the increasing number ofFOIA requests received by this office, we may encounter some delay inprocessing your request. Consistent with the DHS FOIA Regulations 6 C.F.R.§ 5.5(a), FEMA processes FOIA requests according to their order of receipt.  AlthoughFEMA’s goal is to respond within 20 business days of receipt of your request,FOIA does permit a 10-day extension of this time period in certaincircumstances.  As your request seeks documents that will require athorough and wide-ranging search, FEMA will invoke a 10-day extension for yourrequest pursuant to 5 U.S.C. § 552(a)(6)(B).  If you would like tonarrow the scope of your request, please contact our office.  We willmake every effort to comply with your request in a timely manner. Thanks for this information. At a recent public hearing, the Boston Police Department referred to approved and denied overtime reimbursements to the department from FEMA.

I would like either
a) an spreadsheet accounting of overtime reimbursement, allocation, or payment approved and denied to the Boston Police Department as part of federal aid related to the COVID pandemic between 1 March 2020 and 31 December 2020, inclusive

or, if that is not a record you have,

b) the overtime submitted to FEMA by the Boston Police Department, in whatever form that was, for reimbursement, allocation, or payment of overtime as part of federal aid related to the COVID pandemic between 1 March 2020 and 31 December 2020, inclusive.
