Pursuant to the Freedom of Information Act, I hereby request the following records:

Any research reports or analysis documents produced by or in the possession of the Federal Financial Institutions Examination Council (FFIEC) related to developments in financial technology (FinTech) within the financial sector. Specifically, I am interested in reports that discuss the implications of FinTech for the safety and soundness of financial institutions, regulatory compliance, and potential risks to consumers and the financial system.

If my request is denied in whole or in part, please justify all deletions by reference to specific exemptions under the FOIA. I expect the release of all segregable portions of otherwise exempt material. I reserve the right to appeal your decision to withhold any information.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Gabriel Garcia,

This is a response to the inquiry you submitted to the Federal Financial Institutions Examination Council (FFIEC) on Tuesday, May 9, 2023, pursuant to the provisions of the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552. In your email you make this request:

Any research reports or analysis documents produced by or in the possession of the Federal Financial Institutions Examination Council (FFIEC) related to developments in financial technology (FinTech) within the financial sector. Specifically, I am interested in reports that discuss the implications of FinTech for the safety and soundness of financial institutions, regulatory compliance, and potential risks to consumers and the financial system.

Your FOIA request has been assigned a tracking number: FFIEC-023-004, please use this number to reference your request in the future.

Your submission fails to reasonably describe with specificity the records you are seeking; therefore, we are returning it to you for clarification of the date range for the records you seek.

The FOIA provides that federal agencies make their records promptly available to any person who makes a proper request for them. 5 U.S.C. § 552(a)(3)(A). However, an access request must “reasonably describe[]” the records sought. Id.; See, e.g., Marks v. DOJ, 578 F.2d 261 (9th Cir. 1978) (noting “broad, sweeping requests lacking specificity are not permissible” under the FOIA); Lamb v. IRS, 871 F. Supp. 301, 304 (E.D. Mich. 1994) (requests are outside scope of FOIA when they require legal research, are unspecific, or seek answers to interrogatories).
