This is a request under the Freedom of Information Act. I hereby request the following records:
I would like copies of all tweets deleted by the Twitter handle associated with the official Office of the Federal Register (@FedRegister) from October 2009 to the present. This would include any tweets sent out on Twitter that were deleted or kept in draft form from the Twitter handle @FedRegister. This request also would include copies of any e-mails or correspondence regarding the drafting and deletion of these tweets.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am a journalist whose works have appeared in Slate, VICE, the Massachusetts Review, Kill Screen, and elsewhere. This FOIA request is part of research for an ongoing piece of journalistic work, and as such, I am requesting a fee waiver. I have submitted versions of this FOIA request to other agencies, including the Office of Government Ethics, and in the process, I have been granted this fee waiver without question. My most recent article on this subject appeared in Slate in April 2018 and was titled “Can They Really Delete That?”.

You have requested copies of all tweets deleted by the Twitter handle
associated with the official Office of the Federal Register (@FedRegister)
from October 2009 to the present. This would include any tweets sent out on
Twitter that were deleted or kept in draft form from the Twitter handle
@FedRegister. This request also would include copies of any e-mails or
correspondence regarding the drafting and deletion of these tweets.

We are denying your request because have no records responsive to your
request. As a matter of both policy and practice, we don't delete tweets
and we don't carry draft tweets more than a few hours. I have confirmed
that we have not deleted any tweets in the past 2 years. Further, we have
no records of any tweets being deleted between 2009 and present, including
email and other correspondence.

If you are not satisfied with our action on this request, you have the
right to file an administrative appeal within ninety (90) calendar days
from the date of this letter via regular U.S. mail or email. By filing an
appeal, you preserve your rights under FOIA and give the agency a chance to
review and reconsider your request and the agency’s decision. If you
submit your appeal in writing, please address it to the Deputy Archivist of
the United States (ND), National Archives and Records Administration, 8601
Adelphi Road, College Park, Maryland 20740. Both the letter and the
envelope should be clearly marked “Freedom of Information Act Appeal.” If
you submit your appeal by e-mail please send it to FOIA@nara.gov, also
addressed to the Deputy Archivist of the United States. Please be sure to
explain why you believe this response does not meet the requirements of the
FOIA. All correspondence should reference your case tracking number
*FL-25990*.
