This is a request under the Freedom of Information Act. I hereby request the following records:

Copies of contracts with Booz Allen Hamilton over the past 5 years.
Any final reports generated and delivered by Booz Allen Hamilton to the agency over the past 5 years

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This acknowledges receipt of your FOIA request of 14 March 2013 to
USTRANSCOM. Your request is being processed in accordance with Department of
Defense (DoD) Regulation 5400.7, DoD FOIA Program, and has been assigned
USTRANSCOM FOIA No. 13-.

I understand your request to be for the following:

1) Copies of all contracts between Booz Allen Hamilton and U.S. Transportation
Command from 13 March 2008 to 13 March 2013.

2) Any final reports generated and delivered by Booz Allen Hamilton to U.S.
Transportation Command over the past five years.

With regard to the "final reports" segment of your request, the search
parameters may be difficult for us to conduct a proper search and be
responsive in a reasonable amount of time. Our reports would tend to be filed
according to subject, not author. Is there a particular subject we should
search?

Also, Ms. Bien has now retired, and is hopefully enjoying a well-deserved
break on some sandy beach. Our new FOIA email inbox is
ustccs-fo@ustranscom.mil.

Having viewed your request, I do not believe you qualify for the media
exemption. I am unable to give you the total charges for the search, but I
will forward an estimate to you prior to obligating you. Your response to my
request to refine the search concerning the "Final reports" issue above might
help to reduce search fees.

Finally, I believe this will be a complex FOIA request, and one we will not be
able to provide a response to within the statutory twenty (20) business days.
Your response to the above questions will help us narrow our search and
provide a speedier response.

The estimate is for $836.00. Please advise, not later than 10 May 2013,

Further clarification is needed. Per my email below, you failed to respond in
a timely fashion regarding your willingness to pay fees. As shown in the
email below, you needed to advise this office whether you were willing to pay
fees in the estimated amount of $836.00 in order to complete your search.
Since this office did not receive word from you, your request was
administratively closed as of 10 May 2013.

However, should you desire to receive the requested documents, if any, please
advise whether you are willing to pay the fees as described. This office can
re-open your case at that time. Until you indicate your willingness to pay
fees, your FOIA request is not perfected, and this office can take no further
action.

Should you wish to reduce the cost of the search, please consider focusing
your search parameters, as described in my email to you of 25 March 2013,
shown below.

Hi,

Thank you very much for your help and follow up.

Do you know how many contracts with BAH USTRANSCOM has? If you feel the latter part of my request is overly broad, I'm happy to limit it to the first part, for just the BAH contracts, and then follow up with a more narrowed request in the future for the specific reports I'm interested in. Unfortunately, without the contracts I'm not sure what exists and so cannot narrow that part further.

Also, let me know what I need to provide to show I am a media requester. I am a widely-known reporter and editor, and MuckRock is a news publication that is regularly and widely read.

I've updated our contact information for your office, and wish Ms. Bien a happy and enjoyable retirement.

In previous requests, Ms. Bien denied you media status. I intend to follow
precedent, absent objective, compelling evidence to the contrary.

I do not know for certain how many contracts Booz Allen Hamilton has or had
with USTRANSCOM. If you wish to focus the current FOIA request on Booz Allen
Hamilton contracts within the past five years, that would likely be much
quicker and less expensive. I am checking on fees for that request, and
should have an answer for you shortly.

For now, this FOIA request remains unperfected, and closed, as you have not
indicated a willingness to pay the estimated search fees of $836.00. I will
get back to you on the "contracts alone" option, and communicate that as soon
as I receive it.
