Pursuant to the Freedom of Information Act, I hereby request the following records:
On behalf of Al Otro Lado’s #DetentionKills project, I write to request:
1. All Contract Discrepancy Reports issued to ICE detention contractors since President Biden took office.
2. All responses by contractors to Contract Discrepancy Reports issued to ICE contractors since President Biden took office.
3. All notifications by ICE or DHS to any member of Congress or Congressional Committee pertaining to a Contract Discrepancy Report issued since Joe Biden took office.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I hereby appeal the agency’s nearly one-year failure to (1) acknowledge this request; (2) assign it an individualized tracking number; (3) task and complete an adequate search; (4) make all non-exempt responsive records promptly available.
This failure appears to be another example of a longstanding pattern and practice by ICE FOIA of failing to timely acknowledge each FOIA request it receives. We put ICE OPLA and DHS OGC on notice of this pattern and practice on August 13, 2021, and demanded remedial action.
Please instruct the agency to comply with the Act on remand by making these records promptly available. For us, that means releasing them immediately.
