To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

In response to my 1 February 2023 FOIA request to the FBI for "Audio recordings made from FBI wiretaps of the telephone(s) of Elijah Muhammed, leader of the Nation of Islam, who was the target of Bureau electronic surveillance in the 1960s," I received the following notice.

Records potentially responsive to your request were transferred to the National Archives and
Records Administration (NARA). If you wish to review these records, file a FOIPA request with
NARA ... use file number 100-CG-6989, 100-CG-9129 and 157-CG-5366 as a reference.

I do wish to review these records.

Elijah Muhammed died on Feb. 25, 1975 (See; https://en.wikipedia.org/wiki/Elijah_Muhammad)

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Jefferson Morley

From: National Archives And Records Administration – Archival Or Special Access

Dear Jefferson Morley,

I am writing in response to your Freedom of Information Act (FOIA) request
of March 9, 2023 for records in the custody of the National Archives and
Records Administration. Your request was received in this office on
March 9, 2023 and assigned FOIA tracking number *RD 74435*.

You requested access to case files 100-CG-6989, 100-CG-9129, and
157-CG-5366, identified by the FBI as potentially responsive to your
request for audio recordings made from FBI wiretaps of Elijah Muhammed. My
initial assessment is that 100-CG-9129 and 157-CG-5366 are not responsive,
as they do not contain the information you seek. However, Elijah Muhammed
of the Nation of Islam is the subject of 100-CG-6989, compiled as part of a
national security investigation, created between January 4, 1957 and March
17, 1965, and consisting of an estimated 5,000 pages. *Please note that
the responsive parts of this file contain transcripts of wiretapping, and
not the audio records.*

These records require review for information protected from release under
the FOIA: https://www.archives.gov/foia/foia-guide#determine.

The estimated total page count for your request is 5,000 pages. Requests
that exceed 3,000 pages are assigned to our *third-tier* processing queue.
You will receive a response in partial fulfillment of your request after we
have completed the first increment. We will provide you with an update on
the status of your request and an estimated completion date at that time.
To give you an indication of our existing third-tier backlog, we are
currently processing requests received in *August 2013*.

Once we notify you that processing is complete, you may either visit our
College Park, MD facility to view the file at no cost, or order a
reproduction. Our current fee for reproductions is 80 cents per page, so we
estimate the total cost will be *$4,000.00*.

If you are willing to narrow your request for a potentially faster
processing time, please contact us to discuss narrowing options.

You must notify this office of changes to your contact information. If
communication is returned as undeliverable and no return address is
provided, your case will be administratively closed. To change your contact
information or to track the status of your request, please email
specialaccess_foia@nara.gov or call 301-837-3190. Please include your FOIA
tracking number in all communications concerning this request.

If you are not satisfied with our action on this request and would like the
opportunity to discuss our response, you may contact our FOIA Public
Liaison for assistance:
