Good afternoon,

The City Attorney cited that due to active/pending litigation, we cannot release the requested documents at this time.

We previously released to you S. Harrell's personnel file; the only newly added documents are in relation to the active/pending litigation.

A Public Information Act section 552.108(a)(1) Previous Determination (“108 PD”) allows a governmental body to withhold some law enforcement records related to pending cases without needing to request a ruling from the Open Records Division.

Many thanks,
Rhomari Leigh, TRMC

Ms. Leigh,

Thank you for following up with me. Unfortunately I disagree with this application of 108 PD to this request and will be resubmitting this open records request.

Sincerely,

Stuart
