I am requesting the records that relate to "EagleAI Network." This company describes itself as a software that flags voter registrations that appear to have issues.

Therefore, pursuant to Texas Public Information Act, I hereby request the following records:

1) Any contracts, memorandums of understanding, purchase, orders, invoices, and receipts related to "EagleAI" OR "Eagle AI" OR "Eagle A.I."
(The following business names should be captured in the above keyword searches — but for clarity, the business names for Eagle AI include "EagleAI Network, LLC" + "Eagle AI, LLC "+ "Eagle AI Datasciences Inc" + "Eagle AI Solutions, LLC")

2) All instructional materials, presentations and presentation materials (including recorded video and audio, PowerPoint files, prepared remarks, and slides formats), and other guidance on the use of EagleAI. This includes:
A) any notes taken during meetings that discussed the use of "EagleAI" OR "Eagle AI" OR "Eagle A.I."
B) any explanations (whether internally or externally generated) of how "EagleAI" OR "Eagle AI" OR "Eagle A.I." works.
C) any other document that has been used to help explain the use of "EagleAI" OR "Eagle AI" OR "Eagle A.I." to any party, including internal documentation, public relations materials, and executive summaries.

3) Any emails as well as documents, (including but not limited to PDF, word processing, excel, and slide documents) that mention "EagleAI" OR "Eagle AI" OR "Eagle A.I." This includes any correspondence with EagleAI employees, and calendar invitations for meetings with these employees.

Please limit the time frame of all searches to 9/9/2020 to the time that this request is processed.

This FOI request is being filed in pursuit of a time-sensitive news story. Therefore, I ask that my request is expedited. When completing this request, please prioritize whichever records would take the least amount of time to be located and released. I would like these records in electronic format, sent via email or other digital method, and again, please release documents on a rolling basis, as they become available.

Also, I am a member of the news media as a reporter for Business Insider, and the requested documents are in the public interest and not being made for commercial purposes. Therefore, I ask that all fees are waived in the processing of my request. If fees associated with this request will be in excess of $25, kindly notify me in advance of fulfilling this request. As I am making this request as a journalist and this information is timely, I would appreciate your communicating with me if you have questions regarding this request.

Thank you for contacting the Office of the Texas Secretary of State (the "Office"). This email responds to your request for information under the Public Information Act, Chapter 552 of the Texas Government Code (the "PIA"), which was received by the Office on December 12, 2023 (the "Request"). We understand that you have communicated with Alicia Pierce, the Office's Assistant Secretary of State for Communications, regarding your inquiry.

In the Request, you indicate that you are seeking the following information dating back to September 9, 2020:

1. Any contracts, memorandums of understanding, purchase, orders, invoices, and receipts related to "EagleAI" OR "Eagle AI" OR "Eagle A.I."

We are processing the Request in accordance with the PIA. To that end, we do not maintain any information responsive to Items 1 or 2 of the Request.

As Ms. Pierce indicated to you on December 20, we maintain three general categories of records that may be encompassed by Item 3 of the Request: news clips and articles mentioning Eagle AI; emails from the general public mentioning Eagle AI; and public information requests seeking communications containing the term "Eagle AI" (and similar variations), in response to which we provided requestors with news clips, articles, and emails from the general public. Our Office does not have any correspondence with any employee or representative of Eagle AI. Given these limitations, we ask that you clarify whether-and to what extent-you are still seeking to obtain from this Office any of the information identified in Item 3 of the Request.

NOTICE OF APPLICATION OF SEC. 552.222

Under Section 552.222 of the PIA, if you do not respond in writing to this request for clarification within sixty-one days of this communication, your request for information is deemed by Texas law to be withdrawn.
