Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Basic information on all cases (open and closed) of missing American Indian/Alaska Native persons (including juveniles) within your region, from 2000 through 2020; this basic information can include but is not limited to: person name, age, DOB, incident date, case closure date, county/jurisdiction in which person was reported missing.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please be advised that your request for records was received and forwarded to my office for processing.

A comprehensive search of our databases and records yielded no results for cases of missing American Indian/Alaska Native persons under the jurisdiction of the Steuben County Sheriff from 2000 through 2020. Therefore, your request is denied as the records you are seeking do not exist.

Please note, the Sheriff's Office is not the only law enforcement agency that operates within the borders of the county. It is possible another agency may have cases but we do not have access to their records. You will need to contact them directly.

Under Freedom of Information Law you do have the right to appeal a denial of any portion of your application within thirty (30) days from the date hereof to the head of this agency:

We have a few follow up questions:
1. Do you keep records of missing cases in your jurisdiction?
2. Do you keep these records based on race/ethnicity, gender, age, and/or other demographic characteristics?
3. If you do not have any records pertaining to missing Native Americans/Alaska Natives, do you have any records of murdered Native America/Alaska Natives in file in your jurisdiction?

We have not responded as your follow up email falls outside of the scope of FOIL.

Freedom of Information law defines "record" as 'any information kept, held, filed, produced or reproduced by, with or for any agency in any physical form whatsoever'. It further states that an agency is not required to create a new record or provide information in response to questions to comply with the law. Your request is for information, not a request for a record. Therefore your request is denied as it doesn't fall within the parameters of Freedom of Information Law.
