Dear David Guzman,

Pursuant to the state Freedom of Information Act, G.L.M. c.66, €10, I hereby request the following records:

RE: SIP project PY09/10 at 349 Broadway, Somerville, MA:

Please provide me with the following records on file for this SIP Project:

1. a full copy of the original application, including preliminary design plans;

2. a full copy of Contract 10-052 between the Applicant (Bread & Co., Inc. for 349 Broadway location) and the City of Somerville;

3. any and all Building Permit[s] on file for this location issued between 2007 and 2010;

4. Written technical assistance and other documents pertinent only to this SIP including: design and construction plans and specifications; TA regarding modifications required due to Federal, State and local regulations and codes; variance applications, and approved final design plans and specifications;

5. copies of SIP cost documentation, including invoices from contractors or vendors clearly detailing the work performed, cancelled checks to vendors, and Affidavits of Payment;

and

6. Copy[ies] of all OSPCD rebate check[s] issued re: contract 10-052, location 349 Broadway, and SIP participants Bread & Co., Inc..

Please do not include any general guiding documents provided to Applicant written by HUD or State agencies, thank you.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The request is made in the process of community advocacy analysis and news gathering, and is not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

It looked like there was some confusion between this request and another. The request for the 6 permits was fulfilled, however this request is for:

1. a full copy of the original application, including preliminary design plans;
