The California Public Records Act (“Act”) generally exempts most law enforcement records from disclosure, including, among others, records of intelligence information or security procedures of a local police agency; investigatory or security files compiled by local police agencies; and investigatory or security files compiled local agencies for law enforcement purposes. (Gov. Code, § 7923.600, subd. (a).) We will produce records and information that is not exempt under Government Code § 7923.600–7923.615.

We will produce Incident Report No(s).23-89692, which report includes the information that we are required to disclose concerning complaints and requests for assistance pursuant to Government Code § 7923.615. This section provides that we must disclose the information listed below relative to complaints or requests for assistance except to the extent that disclosure of a particular item of information would endanger the safety of a person involved in the investigation, or would endanger the successful completion of that or any related investigation.

· The time, substance, and location of all complaints or requests for assistance received by the agency

· time and nature of the response thereto

· To the extent the crime alleged or committed or any other incident documented, the time, date, and location of occurrence, and the time and date of the report

· The factual circumstances surrounding crime/incident

· A general description of injuries, property, or weapons involved

· The names and ages of victims, except the names of victims of certain listed crimes may be withheld upon request of victim or parent of minor victim. These listed crimes include various Penal Code sections which relate to topics such as sexual abuse, child abuse, hate crimes, and stalking. (Gov. Code, § 7923.615(b)(1).)

SMPD has reviewed your request and has determined that portions of your request are exempt from disclosure pursuant to Government Code Section 7923.605–7923.615. This section exempts two distinct types of records: (1) relevant records which are placed into an investigatory file but were not created by the enforcement agency as part of a specific investigation (e.g, records gathered from victims or witnesses, or from crime scenes or other evidentiary sources relevant to the investigation), and (2) records which were created by the

enforcement agency as part of an investigation. (Haynie v. Superior Court (2001) 26 Cal.4th 1061, 1069.) Those portions of any file that reflect the analysis and conclusions of the investigating officers will also be withheld. (Rackauckas v. Superior Court (2002) 104 Cal.App.4th 169, 174.) The investigatory exemption applies indefinitely even after the investigation is closed. (Rivero v. Superior Court (1997) 54 Cal.App.4th 1048.) Case law makes it clear that neither the termination of an investigation, nor the conclusion of a case removes any applicable exemption under Section 7923.600, subdivision (a). (Williams v. Superior Court (1993) 5 Cal.4th 337, 361-362 Moreover, under no circumstances is the City is required to disclose the “analysis or conclusions” of the investigating officers. (Gov. Code, § 7923.605 (b).)
