Pursuant to the California Public Records Act, I hereby request the following records:

According to an recent press conference by San Francisco, in a daily covid-19 press conference between SFPD and the Mayor's Office, the Mayor announced:

"“We’ve had issues of our orders being relocated by our suppliers in China,” she said. “For example, we had isolation gowns on their way to San Francisco and they were diverted to France. We’ve had situations when things we’ve ordered that have gone through Customs were confiscated by FEMA to be diverted to other locations. We know everyone is dealing with a serious challenge. Therefore I request, for the time period between Jan 1, 2020 to April 24th, 2020:

- records of all PPE's ordered by the city agency in receipt of this request.
- records of all communication about those shipped PPEs and seizures by federal agencies.
- tracking orders, tracking numbers, routing numbers and other documentation that would show the documents as seized.
- I have information and belief to know that Seizures by CBP and other agencies require tracking numbers for entrance into federal agencies such as SEACATS. I request a copy of any seizure letters and documented tracking numbers obtained from federal agencies and which your office is in possession of.
- Communication in possession of your office with other agencies in San Francisco.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Freddy,

Regarding the shipment that is the subject of your request, we subsequently learned that the supplier had provided incorrect information and that FEMA did not actually confiscate the shipment. Mayor Breed has issued a correction to that effect. See the linked report from the San Francisco Chronicle below regarding the Mayor’s statement. Accordingly, we have no records to provide in response to your request. If you have further questions, please let us know.

“1:43 p.m. SF mayor says FEMA did not confiscate protective equipment from city after all: Mayor London Breed on Friday said a shipment of personal protective equipment was confiscated by FEMA and diverted to another location, but on Monday she issued a correction, saying the third-party supplier gave incorrect information. It is unclear what actually happened to the shipment. FEMA, which denied the allegation, is investigating the third-party supplier. “Providing the incorrect information is not only irresponsible, but it’s also very dangerous,” Breed said.”
