From: Freddy Martinez

To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

According to an recent press conference by San Francisco, in a daily covid-19 press conference between SFPD and the Mayor's Office, the Mayor announced:

"“We’ve had issues of our orders being relocated by our suppliers in China,” she said. “For example, we had isolation gowns on their way to San Francisco and they were diverted to France. We’ve had situations when things we’ve ordered that have gone through Customs were confiscated by FEMA to be diverted to other locations. We know everyone is dealing with a serious challenge. Through Customs, we’ve had situations where those items have been taken and put out on the market for the highest bidder, putting cities against cities and states against states.” Source: https://www.sfgate.com/coronavirus/article/Breed-SF-PPE-orders-diverted-to-france-FEMA-15224831.php

Therefore I request, for the time period between Jan 1, 2020 to April 24th, 2020:

- records of all PPE's ordered by the city agency in receipt of this request.
- records of all communication about those shipped PPEs and seizures by federal agencies.
- tracking orders, tracking numbers, routing numbers and other documentation that would show the documents as seized.
- I have information and belief to know that Seizures by CBP and other agencies require tracking numbers for entrance into federal agencies such as SEACATS. I request a copy of any seizure letters and documented tracking numbers obtained from federal agencies and which your office is in possession of.
- Communication in possession of your office with other agencies in San Francisco.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Freddy Martinez

Hi there

A message was sent to you regarding record request #20-2054:

We are acknowledging your Public Records request that we received. In light of the global coronavirus pandemic, including declared State and local San Francisco emergencies, this effort will involve use of scarce public resources. City staff are currently deployed to perform emergency services and/or may be working remotely without access to the records that need review.

Therefore, this is to advise that due to and during the emergency, DPH’s document production may be slower than during the ordinary course of business. DPH will use its best efforts to produce responsive non-exempt records as quickly as possible and will produce records on an incremental or rolling basis. This complies with the common law rule of reason applicable to public records act responses.  (Bruce v. Gregory (1967) 65 Cal.2d 666, 673; Rosenthal v. Hansen (1973) 34 Cal.App.3d 754 (applying rule of reason).)

Requester, we are working with subject matter experts to search for responsive records to this request. The DPH staff are hoping to obtain some clarifying information from you to guide their search:

* Though the user in the request says DPH, can we clarify/specify what the requester is looking for? For example, DPH has various departments that potentially could have been ordering PPE during this time including ZSFG Hospital, Laguna Honda Hospital, SF Health Network, etc. Some of these entities may not be what is of interest to the requester but would impact our timeline in running reports.

* Is the PPE requested here specific to COVID or for everything (eg if a clinic bought some masks or gowns as they normally would as part of routine business, is the requester asking that be included as part of this request?

* For 5 “all communications in possession of your office with other agencies in SF” can they clarify what is it relating to? For #5 this might not be information that we alone have given it is requesting all communications.

Thank you.

Requester, we are hoping to receive further clarification from you on this request (see our previous message). In the meantime, DPH can confirm it has no responsive records to items #3 and #4 on your list:

3. tracking orders, tracking numbers, routing numbers and other documentation that would show the documents as seized We don’t have any communications for seizures by federal agencies.

4.  I have information and belief to know that Seizures by CBP and other agencies require tracking numbers for entrance into federal agencies such as SEACATS. I request a copy of any seizure letters and documented tracking numbers obtained from federal agencies and which your office is in possession of. Same answer as question 3.

Thank you.

A message was sent to you regarding record request #20-2054:

Requester,

Regarding item #2 on your list (records of all communication about those shipped PPEs and seizures by federal agencies):

* The Department of Public Health has conducted a diligent search for records responsive to your request. We have found none. The Department orders PPE from distributors, who would have gotten their goods from a vendor or manufacturer. Any seizures that you refer to in your request would likely have occurred at the manufacturer level.
