Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, ยง 3(b)), I hereby request the following records:

A list of waived parking tickets processed between Jan. 1, 2011 and Feb. 17, 2014, including the license plate on the citation, the name of the individual cited, and the name of the official who waived the ticket, and any documentation as to why these tickets were waived.

I ask that you please provide the records in their original electronic format. Please contact me with any questions about the format.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Williams,

This letter is in response to your California Public Records Act (CPRA) request dated . Under the rules of CPRA, we are hereby making responsive documents in our possession available for you, except for records which may be exempt from disclosure under the Act. The items you requested were:

A list of waived parking tickets processed between Jan. 1, 2011 and Feb. 17, 2014, including the license plate on the citation, the name of the individual cited, and the name of the official who waived the ticket, and any documentation as to why these tickets were waived.

Please find attached with this email a list of waived (dismissed) parking tickets including the citation number, issue date and license plate number.

The names of the individuals cited cannot be released according to Government Code 6254(k) disclosure is prohibited by federal or state law. California Vehicle Code 1808 prohibits the release of personal information.

There is a system that contains citation information and a different system that contains the appeals/dismissal data. In order to provide a report containing all the data requested, a report would have to be created. The creation of a report that is not currently in existence- is not a public record. GC 6253(a).

Thank you, Mr. Salvador. I appreciate your timely response. I have a few questions and a follow up request. First, is the name of the official who waived the ticket included in the citation system? If so, why isn't this information included in the responsive records?

Also, for the records you provided, could you please include the last name, or a portion of the last name, of the individual cited and redact the rest?

Lastly, I would like to please request under the California Public Records Act the "appeals/dismissal" data showing "IssueNo" and reason for dismissal or waiver.

Below is the explanation from the Office of the City Treasurer, which handles parking citations (not the police department).

We had this exact same request from the same entity about two years ago. Here's what we communicated then:
1. The name of the individual cited cannot be provided as we get that information from the DMV; our agreement with the DMV precludes us from providing any information to anyone under any circumstance.

2. We have one system that citation information and a different system that houses all appeals/dismissal data. In order to provide a report with all the data they want, special programming would have to be done by our vendor to merge multiple data tables.

The creation of a report that is not currently in existence- is not a public record. GC 6253(a).
