Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:
All health and safety related case files and complaints on behalf of tobacco farmworkers that include the word "nicotine poisoning," spanning from July 1st 2020-September 1st 2020, July 1st 2021-September 1st 2021, and July 1st 2022 - Present.
This will be published by the national outlet Civil Eats with funding from Berkeley Journalism School.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Mr. Nash,
I am in receipt of your emails dated July 13, 2022 requesting any/all information for case files on Nicotine cases between January 1990- June, 2022 as well as July 1st 2020-September 1st 2020, July 1st 2021-September 1st 2021, and July 1st 2022 - Present. I have forwarded your request to our Regional Health Directors for research. Please be advised of the following:
1. Our database is employer/site specific.
2. We will provide hardcopy only of any results. Our charges are as follows: $0.10/page + $17.98 research/process time + $20.00/photo/CD. An estimate is not possible because the file must come from our regional office to me for processing
3. The Department has a policy requiring destruction of inspection files after three (3) years have lapsed from the date closed. Therefore, unless a case file is still open, i.e. in litigation or under contest, all files are destroyed after that 3 year time period. However, we do report to Federal Osha as normal procedure. Therefore, any older files would only be accessible from their website as a case audit.
Once I have an answer from our regional offices, I will be back in touch.
