Office of Student Conduct

Dear Kimberly Woods:

Pursuant to the Nevada Open Records Act § 239 et seq., I am requesting the following records: any digital communications (including but not limited to emails and text messages) as well as documents, (including but not limited to plain text file, PDF, word processing, spreadsheets, slide documents, faxes, google alerts, and xml) with any of the following insensitive keywords: “coronavirus” “COVID-19” “Code of Conduct” “disorderly conduct” “unauthorized use of university technology” “university community” “willful incitement” “failure to comply” “off-campus” “voter fraud” “conduct that threatens or endangers the health or safety of any member or guest of the University Community” “acts of dishonesty” “large gathering” “party” “arrest” “incarcerate” “incarcerating” “complaint” “fraud” “hazing” “citation” “Washoe County Sheriff” “Sheriff” “RPD” “Reno Police” “Sparks Police” “SPD” “University Police” “Board of Regents” “endanger” from August. 3, 2015 to present.

Please supply a receipt detailing the charges for each document. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public
interest and is not being sought for commercial purposes, as I am an undergraduate student at the at the University of Nevada, Reno and am contributing to a class project within the Reynold’s School of Journalism.

If you choose to deny this request, please supply a written explanation for the denial, including a reference to the specific statutory exemption(s) upon which you rely. Also, please supply all
segregable portions of otherwise exempt material.

If access to the records I am requesting will take longer than a “reasonable” amount of time, please contact me with information about when I might expect copies or the ability to inspect
the requested records.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires business days, as the statute requires.

Sincerely,

Asher S. Dunn

Dear Mr. Dunn,

The University would like to work with you to narrow your request.

Your request includes 30 search terms of records over a more than 5-year period, one of which is “Board of Regents.” Your request appears to include a request for employee emails. The University has over 6,000 employees. The term “Board of Regents,” alone, could very well appear on tens of thousands, if not hundreds of thousands, of documents.

No specific record has been identified. In order to inspect or copy a public record, the specific record must be identified by the person requesting the document. Courts in addressing this issue have held that “agencies are required to disclose only ‘identifiable’ governmental records not otherwise exempt. Wholesale requests for general information to be analyzed, collected and compiled by the responding government entity are not encompassed therein.” Hodai v. City of Tucson, C20141225 (Ariz. Super. Ct. 2014) citing mag Entertainment LLC v. Div. of Alcohol Beverages Control, 868 A.2d 1067, 1076 (N.J. Sup. Ct. App. Div. 2005). A government agency is not required to respond to an overbroad request that does not request specific records. Id. at 1074, citing Capitol Info. Assoc. v. Ann Arbor Police, 360 N.W.2d 262, 263 (1985).

When can you be available to discuss narrowing the request?

Sincerely,
