Pursuant to the Nevada Public Records Act, I hereby request the following records:

Any and all written documents that include, but are not limited to, policies, procedures, training manuals, talking points and slideshows that include the topic of non-discrimination and anti-bullying policies regarding LGBT identified students. This includes, but is not limited to, policies on the use of bathroom facilities. Any and all records, reports or documents that detail all voluntary agreements made between the school and The Office of Civil Rights following a discrimination complaint. Please limit this request to documents that were generated over the past two years as well as documents, such as policies, that are in effect now.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The University responds to your request as follows:

The request is overbroad. No specific record has been identified. In order to inspect or copy a public record, the specific record must be identified by the person requesting the document. Courts in addressing this issue have held that "agencies are required to disclose only 'identifiable' governmental records not otherwise exempt. Wholesale requests for general information to be analyzed, collected and compiled by the responding government entity are not encompassed therein." Hodai v. City of Tucson, C20141225 (Ariz. Super. Ct. 2014) citing mag Entertainment LLC v. Div. of Alcohol Beverages Control, 868 A.2d 1067, 1076 (N.J. Sup. Ct. App. Div. 2005). A government agency is not required to respond to an overbroad request that does not request specific records. Id. at 1074, citing Capitol Info. Assoc. v. Ann Arbor Police, 360 N.W.2d 262, 263 (1985). The request is a broad demand, not a request for a specific record.

The University has over 6,000 employees. Without identification of a specific record, it would be virtually impossible to determine whether the records requested exist or who would have the records requested.

In an effort to work with you, the University seeks clarification of your request. Please provide the name of the individual whose records you seek and specify the name of the record you are requesting.

The University has signed no voluntary resolution agreements with the Office of Civil Rights in the last two years.
